1. Agreement to Terms

By accessing or using formspoken ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

formspoken is a voice-first form platform that enables users to create forms that accept voice responses. The Service includes:

  • Form creation and customization tools
  • Voice recording and transcription
  • AI-powered response analysis
  • QR code and link generation
  • Analytics and reporting
  • Data export capabilities

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Credit System and Payments

Credits

The Service uses a credit-based system. Credits are consumed when voice responses are processed (transcribed and analyzed). Each processed response uses one credit.

Subscription Plans

We offer various subscription plans with different credit allocations. Plan details and pricing are available on our pricing page.

Billing

  • Subscriptions are billed monthly or annually
  • Credits are allocated at the start of each billing period
  • Unused credits may roll over based on your plan
  • Refunds are handled according to our refund policy

Free Tier

New accounts receive 25 free credits. Free credits do not expire but are not replenished.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Collect data without proper consent from respondents
  • Transmit harmful, offensive, or illegal content
  • Impersonate others or misrepresent your affiliation
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any systems
  • Use the Service for spam or unsolicited communications
  • Scrape or harvest data from the Service

6. Content and Data

Your Content

You retain ownership of all content you create or upload, including forms, questions, and branding assets. You grant us a license to use this content solely to provide the Service.

Respondent Data

You are responsible for ensuring you have proper consent to collect voice recordings and other data from form respondents. You must provide appropriate privacy notices to respondents.

AI Processing

Voice recordings and text data are processed by third-party AI services (OpenAI, Anthropic) for transcription and analysis. By using the Service, you consent to this processing.

7. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by formspoken and protected by intellectual property laws. The "formspoken" name, logo, and branding are our trademarks.

Powered by Badge

Forms created on Free, Starter, and Growth plans display a "Powered by formspoken" badge. Business plan subscribers may remove this badge.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR THE ACCURACY OF AI-GENERATED TRANSCRIPTIONS OR ANALYSIS

9. Indemnification

You agree to indemnify and hold harmless formspoken from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon termination:

  • Your access to the Service will be revoked
  • Your data will be deleted within 30 days
  • You can export your data before termination
  • No refunds are provided for partial billing periods

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects the Service. We are not liable for any downtime or service interruptions.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which formspoken operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.
